PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Public Service Commission is considering a filing by Arbor Hills Waterworks, Inc. requesting approval to increase its restoration of service charges.
Statutory authority:
Public Service Law, sections 4(1), 5(1)(f), 89-c(1) and (10)
Subject:
Water rates and charges.
Purpose:
To approve an increase in the restoration of service charges.
Text of proposed rule:
On September 17, 2009, Arbor Hills Waterworks, Inc. (Arbor or the company) submitted a filing requesting permission to increase its restoration of service charges from $75 to $170 during normal business hours (8:00 a.m. to 4:00 p.m., Monday through Friday), from $100 to $212.50 outside of normal business hours Monday through Friday, and from $150 to $260 on weekends and public holidays. Arbor provides metered water service to 67 residential customers in the Arbor Hills Development in Westchester County. The Commission may approve or reject, in whole or in part, or modify the company's request.
