PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On September 17, 2009, the PSC adopted an order permanently staying its 11/24/08 Order approving the Submetering of Electricity at 1890 Lexington Avenue and 1990 Lexington Avenue, New York, New York.

Public Service Law, sections 2, 4(1), 5, 22, 23, 30, 32, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 46, 48, 51, 53, 65 and 66

Adoption to permanently stay the Commission order issued November 24, 2008.
Substance of final rule:
The Commission, on September 17, 2009, adopted an order permanently staying its November 24, 2008 order approving the Petition of KNW Apartments, LLC to submeter electricity at 1890 Lexington Avenue and 1990 Lexington Avenue, New York, New York, until such time as the Building Owners have submitted to the Commission a plan to comply or to demonstrate compliance with the further conditions, subject to the terms and conditions set forth in the order.
