Whether the Proposed Provision of Water Service by Saratoga Water Services in the Town of Malta is in the Public Interest
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The PSC is considering a petition by Saratoga Water Services, Inc. for the issuance of an Order waiving tariff provisions and approving terms of an agreement regarding the provision of water service in the Town of Malta, Saratoga County.
Statutory authority:
Public Service Law, sections 4(1), 20(1) and 89-b
Subject:
Whether the proposed provision of water service by Saratoga Water Services in the Town of Malta is in the public interest.
Purpose:
Whether the Commission should issue an order approving the requested waiver and provision of water service.
Substance of proposed rule:
The Commission is considering a Petition in which Saratoga Water Services, Inc. (Saratoga) seeks issuance of an Order (a) approving the terms and conditions of a certain "Agreement For The Provision of Water Service", dated November 7, 2007 (Agreement) as being in the public interest; (b) determining that the provision of water service by Saratoga in accordance with the terms set forth in the Agreement, is in the public interest; (c) waiving Saratoga's tariff provisions to the extent they are inconsistent with the Agreement and (d) waiving the applicability of the provisions of 16 N.Y.C.R.R. Parts 501 and 502, to the extent they are inconsistent with the Agreement.
