PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a complaint from the Pactiv Corporation asking that it and similarly situated customers be exempted from the increase in the non-bypassable charge implemented by Rochester Gas and Electric Corporation (RG&E) on June 1, 2009.
Statutory authority:
Public Service Law, sections 64, 65(1), (2), (3), (5) and 66(1), (2), (5), (8), (9), (10) and (12)
Subject:
The increase in the non-bypassable charge implemented by RG&E on June 1, 2009.
Purpose:
Considering exemptions from the increase in the non-bypassable charge implemented by RG&E on June 1, 2009.
Substance of proposed rule:
The Public Service Commission is considering a complaint from the Pactiv Corporation asking that it and similarly situated customers be exempted from the increase in the non-bypassable charge implemented by Rochester Gas and Electric Corporation (RG&E) on June 1, 2009. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
