Notice of Abandoned Property Received by the State Comptroller
Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. NOTICE OF PUBLIC HEARING
Division of Housing and Community Renewal New York State Annual Action Plan
To administer federal funds for the Community Development Block Grant (CDBG), Home Investment Partnerships (HOME), Emergency Shelter Grants (ESGP), and Housing Opportunities for Persons with AIDS (HOPWA) programs, New York State must prepare an Annual Action Plan (AAP). New York State’s next AAP will describe the State’s anticipated use of federal CDBG, HOME, ESGP, and HOPWA funds in 2010 to address affordable housing and community development needs identified in its Consolidated Plan for 2006-2010. This AAP will also describe the State’s methods for distributing these funds to local grantees.
Interested individuals and organizations are encouraged to participate in the development of New York State’s 2010 AAP by submitting written comments to: NYS DHCR, Attention: Brian McCarthy, 38-40 State Street, Albany, NY 12207, or [email protected]. All written comments must be received by June 8, 2009.
The Public is encouraged to offer oral comments at public hearings on June 3, 2009 and June 4, 2009. On June 3rd, the first public hearing will be held from 9:00 am until 10:00 am and the second from 2:00 pm until 3:00 pm. On June 4th, the first public hearing will be held from 9:00 am until 10:00 am and the second from 2:00 pm until 3:00 pm. At these dates and times, hearings will be held concurrently at the following four New York State Division of Housing and Community Renewal offices: 25 Beaver Street in New York City; 38-40 State Street in Albany; 620 Erie Boulevard West in Syracuse; and 535 Washington Street in Buffalo. Division of Housing and Community Renewal Community Development Block Grant - Recovery (CDBG-R) Program Substantial Amendment to New York State 2008 Action Plan Public Comment Period Announcement
On February 17, 2009, President Obama signed the American Recovery and Reinvestment Act of 2009, which includes $1 billion in supplemental Community Development Block Grant (CDBG) Program funds to be used to stimulate the economy through measures that modernize the Nation's infrastructure, improve energy efficiency, and expand educational opportunities and access to health care through the creation of suitable living environments; provision of decent affordable housing; and creation of economic opportunities primarily benefiting persons of low- and moderate-income. Funding for this supplemental appropriation, called the Community Development Block Grant Recovery (CDBG-R) Program, is being allocated based on the existing statutory formulas used for the regular annual allocation of CDBG funds. In order to receive CDBG-R funds, eligible grantees must submit a substantial amendment to their Consolidated Plan 2008 Action Plan by June 29, 2009. The allocation under the CDBG-R Program for the New York State Program is approximately $12.8 million and funds will be administered by the New York State Office of Community Renewal (OCR).
Use of CDBG-R funds is the subject of the CDBG-R substantial amendment to the New York State 2008 Action Plan. Eligible uses for CDBG-R assistance include the full range of CDBG-eligible activities, in particular: economic development; housing; infrastructure and other public facilities activities that will quickly spur further economic investment; increased energy efficiency; and job creation or retention. CDBG-R grantees must ensure that 70% of their grant funds be used for activities that benefit low- and moderate-income persons.
In accordance with HUD guidelines, the CDBG-R substantial amendment to the 2008 Action Plan for the New York State Program must be published for no less than 7 calendar days for public comment before being submitted to HUD by the June 29, 2009 deadline.
This 7-day public comment period will begin on Friday, June 5, 2009 and extend through close of business on Thursday, June 11, 2009. Beginning on June 5, 2009, the CDBG-R substantial amendment to the New York State 2008 Action Plan may be viewed on and downloaded from the New York State Division of Housing and Community Renewal (DHCR) website at www.nysdhcr.gov. In addition, copies can be requested by e-mail ([email protected]) or by calling 1-866-ASK-DHCR (275-3427).

In F-2009-0018, Earl Rounds is seeking approval from the U.S. Army Corps of Engineers, Buffalo District, for the construction of a 12 foot wide by 20 foot long deck over Salmon Creek in the Town of Greece, Monroe County. The property is located at 414 Manitou Road. There are currently The proposed deck would be in addition to 2 existing docks already present at the property. The stated purpose of this activity is for access to the water.

In F-2009-0118, the Club at Bayberry Harbor Homeowners Association is seeking approval from the U.S. Army Corps of Engineers, New York District for several shoreline construction activities on their property. The subject property is located on Ocean Avenue, Orowoc Creek, Town of Islip, Suffolk County.
Beginning at the south end of the site and moving north, the proposal involves the following:
• installation of ˜135 lf of new stone armoring to tie into existing gabion to the north;
• maintenance and repair of 227 lf of existing gabion, in-place;
• removal of a 30 ft. groin;
• removal of a 14 lf portion of existing groin at the seaward edge;
• reconstruction, in-place, of ±277 lf of timber bulkhead with vinyl;
• reconstruction, in-place, of ±60 lf of timber jetty with vinyl;
• reconstruction, in-place, of ±955 lf of timber bulkhead within boat basin with vinyl;
• maintenance dredging of the boat basin and basin inlet, an area of 40,660 ft², to a depth of -4′ MLW. The resultant 3,000cy of sand will be partially re-used on-site (˜455cy) and the remaining 2,545cy to be disposed of off-site.
• reconstruction, in-place, of ±60 lf of solid-filled timber jetty with vinyl;
• removal of ˜275 lf of gabion, and replacement with ˜275 lf of vinyl sheathing retaining wall with stone armor (18″ - 36″ stone placed on filter fabric) at or above MHW;
• removal of the existing remains of deteriorated bulkheads with disposal at an off-site location;
• installation of ˜590 lf of low-sill vinyl bulkhead at, above and below MLW (variable location along shoreline) at an elevation of 1′ below MHW. Bulkhead will have 4″ holes cut in every-other sheet just above grade on landward side to allow for drainage on out-going tides;
• creation of wetlands landward of low-sill bulkhead using ±500cy of dredged material, and planted with Spartina patens and Spartina alternaflora (2″ peat pots, 18″ on center);
• placement of additional material, if available, landward of proposed wetlands and planted with Ammophila breviliqulata ("Beachgrass" - 12″ o.c.), Myrica pensylvanica ("Bayberry" - 2gal. Container, 6′ o.c. in random clump formation), and Prunus maritima ("Beach Plum" - 2gal. Container, 6′ o.c. in random clump formation).
The stated purpose of the proposal is to provide shoreline stabilization, the prevention of flooding and erosion, and to provide for safe navigation/recreational mooring.

Department of Taxation and Finance Interest Rates
Pursuant to the provisions of subsection (j) of section 697 of the Tax Law, the Commissioner of Taxation and Finance hereby sets the overpayment rate of interest for the purposes of said subsection for the months of July, August, and September 2009, at 3 percent per annum; and sets the underpayment rate of interest for the purposes of said subsection for the months of July, August, and September 2009, at 7 and one-half percent per annum. These rates are applicable to the New York State personal income tax (Article 22 of the Tax Law - except for rates of interest payable by or to an employer with respect to income taxes required to be withheld and paid over by the employer pursuant to Part V of such Article 22), unincorporated business income tax (Article 23 of the Tax Law), estate tax (Article 26 of the Tax Law), generation-skipping transfer tax (Article 26-B of the Tax Law), the New York City resident income tax (Article 30 of the Tax Law, Chapter 17 of the New York City Administrative Code), the New York City nonresident earnings tax (Article 2-E of the General City Law, Chapter 19 of the New York City Administrative Code), the City of Yonkers resident income tax surcharge (Article 30-A of the Tax Law, Article IX of the Codes and Ordinances of the City of Yonkers) and the City of Yonkers nonresident earnings tax (Article 30-B of the Tax Law, Article X of the Codes and Ordinances of the City of Yonkers).
Pursuant to the provisions of subsection (e) of section 1096 of the Tax Law, the Commissioner of Taxation and Finance hereby sets the overpayment rate of interest for the purposes of said subsection for the months of July, August, and September 2009, at 3 percent per annum; and sets the underpayment rate of interest for the purposes of said subsection for the months of July, August, and September 2009, at 8 percent per annum. These rates are applicable to the New York State corporation tax (Article 9 of the Tax Law), franchise tax on business corporations (Article 9-A of the Tax Law), franchise tax on state banks, trust companies, financial corporations and tax on savings and loan associations (Article 9-B of the Tax Law), tax on national banking associations and production credit associations (Article 9-C of the Tax Law), motor fuel and diesel motor fuel taxes (Article 12-A of the Tax Law), unrelated business income tax (Article 13 of the Tax Law), petroleum businesses tax (Article 13-A of the Tax Law), taxes on alcoholic beverages (Article 18 of the Tax Law), taxes on boxing and wrestling exhibitions (Article 19 of the Tax Law), tax on cigarettes and tobacco products (Article 20 of the Tax Law), highway use tax (Article 21 of the Tax Law), interest payable by or to an employer with respect to income taxes required to be withheld and paid over by the employer pursuant to Part V of Article 22 of the Tax Law, State and local sales and use taxes administered by the Commissioner of Taxation and Finance (Articles 28 and 29 of the Tax Law), special tax on passenger car rentals (Article 28-A of the Tax Law), real estate transfer tax (Article 31 of the Tax Law), franchise tax on banking corporations (Article 32 of the Tax Law), franchise taxes on insurance corporations (Article 33 of the Tax Law), tax on independently procured insurance (Article 33-A of the Tax Law), the special assessments on hazardous waste (section 27-0923 of the Environmental Conservation Law), underpayments or overpayments relating to the deposit and disposition of refund values by a deposit initiator (section 27-1012 of the Environmental Conservation Law), waste tire management and recycling fee (section 27-1913 of the Environmental Conservation Law), and underpayments or overpayments of the mortgage recording tax (Article 11 of the Tax Law) in cities having a population of one million or more.
No underpayment rate set hereby shall be less than 7 and one-half percent per annum. The underpayment rate for State and local sales and use taxes administered by the Commissioner of Taxation and Finance shall not be less than 14 and one-half percent per annum. The underpayment rate for the special assessments on hazardous waste imposed by section 27-0923 of the Environmental Conservation Law shall be 15 percent.
