Electric Utility Projects That May Qualify for Partial Funding Under the Federal American Recovery and Reinvestment Act of 2009
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering whether to approve, reject or modify, in whole or in part, the filings of several electric utilities seeking recovery of potential costs associated with utility projects that may qualify for partial federal funding.
Statutory authority:
Public Service Law, sections 4, 5, 6, 65 and 66
Subject:
Electric utility projects that may qualify for partial funding under the federal American Recovery and Reinvestment Act of 2009.
Purpose:
To determine the extent of costs associated with electric utility projects that may be recovered from ratepayers.
Substance of proposed rule:
The Public Service Commission (Commission) is considering whether to accept, reject or modify, in whole or in party, the filings of Consolidated Edison Company of New York, Inc., Orange and Rockland Utilities, Inc., Niagara Mohawk Power Corporation d/b/a National Grid, Central Hudson Gas and Electric Corporation, New York State Electric and Gas Corporation, Rochester Gas and Electric Corporation, seeking Commission approval of recovery of certain costs associated with utility projects that may be eligible for a grant (covering up to 50 percent of the project costs) from the United States Department of Energy (DOE) under its Electricity Delivery and Energy Reliability (EDER) Program, which is funded by the American Recovery and Reinvestment Act of 2009. Among the issues to be considered are the cost and benefits associated with each proposed utility project, the proposed project’s impact on the reliability of New York’s electric system, and the likelihood that the utility may receive a grant from DOE under the EDER program. The Commission may also consider other matters related to the submission of utility project filings.
