Lightened Regulation and Financing of an Electric Generation Facility
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition dated March 10, 2009 from Astoria Generating Company, L.P. requesting that its proposed 100 MW generation facility in Brooklyn, New York be subject to lightened regulation and that its financing be approved.

Subject:

Purpose:
Consideration of lightened regulation and financing of an electric generation facility.
Substance of proposed rule:
The Public Service Commission is considering a petition dated March 10, 2009 from Astoria Generating Company, L.P. requesting that its proposed 100 MW simple cycle combustion turbine and generator facility to be installed at its existing generation site in Sunset Park, Brooklyn, New York be subject to lightened regulation, and that a financing in the amount of no more than $130 million supporting construction and operation of the facility be approved. The Commission may adopt, reject or modify, in whole or in part, the relief proposed.
