Purpose:

A significantly amended version of the proposed New York State Hazardous Waste Facility Siting Plan is available for public review. The Siting Plan, required by state Environmental Conservation Law (ECL) Section 27-1102, is primarily intended to assess the State's capacity for managing hazardous waste in accordance with State and Federal law, and to assure adequate availability of industrial hazardous waste treatment, storage and disposal facilities into the future. The final adoption of a Siting Plan is a prerequisite for the siting or significant expansion of certain new hazardous waste facilities in New York.

With the draft plan, DEC has also issued a draft Generic Environmental Impact Statement (GEIS) for public review. The GEIS evaluates and addresses any potential impacts the Siting Plan may have on the environment. However, it does not replace the need for a separate and distinct site-specific EIS for any hazardous waste management facility that is proposed to be sited or expanded in New York State in the future.

Hearings have been planned across the State to provide an initial opportunity for public comment. The hearing locations are reasonably accessible to the mobility-impaired. Interpreter services can be made available to the hearing-impaired at no charge, upon request to the Department within a reasonable time period prior to the hearings. A second round of hearings will be scheduled after comments on the current draft are evaluated and a revised draft is published.

All persons, organizations, corporations, government agencies, and others wishing to comment on the proposed Siting Plan are invited to attend the hearings and to submit either written or oral statements. Reasonable time limits may be set for each speaker to afford everyone an opportunity to be heard. Lengthy statements should be submitted in writing and summarized for oral presentation. Written statements received prior to the close of the public comment period and oral statements made at each hearing session will be given equal weight.

The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for inpatient hospital, long term care and non-institutional services to comply with recently enacted statutory provisions. The following provides clarification to previously noticed amendments and notification of new significant changes.

Inpatient Hospital Services

• As previously approved, rates of payment for general hospital inpatient services provided on and after April 1, 2008, will include a 2008 trend factor equal to 65% of the otherwise applicable trend factor 2008 for the calendar year.

Effective for services rendered on and after September 10, 2008, an adjustment will be made applicable to such rates of payment based on a 1.3% annualized reduction applicable to the final 2008 trend factor that applies to the April 1, 2008 through December 31, 2008 period.

Effective for general hospital inpatient services provided on and after January 1, 2009, rates of payment shall include a 2009 trend factor equal to the 2009 published Consumer Price Index less 1%.

Long Term Care Services

• As previously approved, rates of payment for inpatient services provided by residential healthcare facilities (RHCFs), except those that provide extensive nursing, medical, psychological and counseling support services to children, provided on and after April 1, 2008, will include a 2008 trend factor equal to 65% of the otherwise applicable trend factor 2008 for the calendar year.

Effective for services rendered on and after September 10, 2008, an adjustment will be made applicable to such rates of payment based on a 1.3% annualized reduction applicable to the final 2008 trend factor that applies to the April 1, 2008 through December 31, 2008 period.

Effective for such services provided on and after January 1, 2009, rates of payment shall include a 2009 trend factor equal to the 2009 published Consumer Price Index less 1%.

Non-Institutional Services

• As previously approved, rates of payment for outpatient services provided by general hospitals, adult day health care services provided by RHCFs, home health care services provided by certified home health agencies (CHHA) other than for services provided to patients diagnosed with AIDS/HIV, and personal care services, except for services provided in local social service districts, including New York City, where rates of payment for such services are established by such local social service districts pursuant to a rate-setting exemption, provided on and after April 1, 2008, will include a 2008 trend factor equal to 65% of the otherwise applicable trend factor 2008 for the calendar year.

Effective for services rendered on and after September 10, 2008, an adjustment will be made applicable to such rates of payment based on a 1.3% annualized reduction applicable to the final 2008 trend factor that applies to the April 1, 2008 through December 31, 2008 period.

Effective for such services provided on and after January 1, 2009, rates of payment shall include a 2009 trend factor equal to the 2009 published Consumer Price Index less 1%.

The estimated annual net aggregate decrease in gross Medicaid expenditures attributable to this proposed initiative for state fiscal year 2008/2009 is $36 million and will increase to $340 million in state fiscal year 2009/2010.

In F-2008-0695 DA, the U.S. Army Corps of Engineers (COE), Department of the Interior, is proposing to perform maintenance dredging of the existing navigation channel at Moriches Inlet. Moriches Bay, Town of Brookhaven, Suffolk County.

The proposed dredging will remove approximately 236,000 cubic yards of sand, to be placed along the Atlantic Ocean Beach as nourishment at or about 8000 feet (or 1.5 miles) west of the west jetty.
