Department of State F-2008–0567 (DA) Date of Issuance- August 20, 2008
The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The United States Coast Guard, Department of Homeland Security, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2008-0567 DA, the U.S. Coast Guard, Department of Homeland Security, has applied to the U.S. Army Corps of Engineers, New York District, for the renewal of their permit to perform maintenance dredging of the navigation channel at Eaton’s Neck, Huntington Bay, Town of Huntington, Suffolk County.
The proposed dredging will remove approximately 8,000 cubic yards of sand annually, to be placed at one of three designated beach nourishment sites. The disposal sites are designated at the following locations: The Eaton’s Neck Coast Guard Station property along the shoreline of Long Island Sound, the Town of Huntington owned property known as North Creek along the shoreline of Huntington Bay, and the Town of Huntington owned property located at Essex Drive along the shoreline of Huntington Bay.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activity may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or September 5, 2008.

Department of State Community Services Block Grant Management Plan Amendment
The New York State Department of State, as the designated lead agency for Community Service Block Grant (CSBG) and related programs in New York, is responsible for the development and implementation of this state’s Management Plan and any amendments thereto. For the purpose of fostering greater innovation and effectiveness in combating poverty within the State of New York, the New York State Department of State has prepared a proposed CSBG Management Plan Amendment for Federal Fiscal Years 2008-2009. Pursuant to 42 U.S.C. § 9908(e)(1), this proposed Management Plan Amendment was made available for public inspection in the following ways: (1) a copy of the amendment was sent to eligible entities with a cover letter on June 20, 2008, and (2) the amendment and the June 20, 2008 cover letter were posted on the Department of State’s public website on June 23, 2008, and (3) the amendment was published in the July 2, 2008 edition of the New York State Register. During the public comment period, which closed with the close of business on July 21, 2008, five comments were received. All comments received are considered and discussed in detail in the “Assessment of Public Comment” printed as an Appendix in this issue.

The building is 3 stories in height, of Type IB (fire resistive) construction, having a cumulative gross floor area of 93,000 square feet. The building is located at 255 Fuller Road, City of Albany, Albany County, State of New York.
2008-0449 Matter of Pat Hotung, 2100 Liberty Building, Buffalo, NY 14202 for a variance concerning sprinkler requirements in high rise building.
Involved is: the alterations to a 22 story, fire resistive building for business occupancy, located at 424 Main Street, City of Buffalo, County of Erie, State of New York.
2008-0455 Matter of William B. Fink Jr., PE, HA2F Consultants in Engineering, One Van Patten Drive, Clifton Park, NY 12065 for a variance concerning the use of an energy recovery ventilation system in a location that is prohibited by the NYS Mechanical Code (2007).
Involved is the renovation of an existing welding laboratory located in the Washington, Saratoga, Warren, Hamilton, Essex BOCES facility. The building contains an E occupancy, is one story in height, of Type 2B (non-combustible) construction, having a cumulative gross floor area of 18,500 square feet. The building is located at 1051 Dix Avenue, Village of Hudson Falls, Washington County, State of New York.
2008-0456 Matter of Liseli Haines Property Manager, The Powell House, 524 Pitt Hall Rd. Old Chatham, NY 12136 for a variance concerning fire safety issues including the requirement for the installation of a sprinkler system.
Involved are alterations and additions to an existing building. The building contains an R-1 (multiple dwelling) occupancy, is 2 stories in height, of Type VB (wood frame) construction, having a cumulative gross floor area of 7,700 square feet. The building is located at 524 Pitt Hall Rd., Town of Chatham, Columbia County, State of New York.
2008-0457 Matter of Leonard G. Angerame, Angerame Architects, 30 Essex Street, Albany, NY 12206-2027 for a variance concerning fire safety issues including the prohibition of having openings in party walls.
Involved is the construction of an addition to an existing nursing home. The addition contains an I-2 (institutional) occupancy is 2 stories in height, of Type IIA (fire resistive) construction, having a cumulative gross floor area of 59,000 square feet. The completed building will have a cumulative gross floor area of 135,000 square feet. The building is known as the Kingsway Arms Nursing Center and is located at 323 Kings Rd., City of Schenectady, Schenectady County, State of New York.

Involved is the reconstruction of a row house that burned completely. A new in-fill building will be built on the vacant lot and is designed to replicate the former building along with it’s elevated entrance. The building contains an R-2 (multiple dwelling) occupancy, is 3 stories in height, of Type V-A (wood frame) construction, having a cumulative gross floor area of 6,400 square feet.
