Brownfield Opportunity Areas Program
The Brownfield Opportunity Areas Program provides municipalities and community based organizations with assistance, up to 90 percent of the eligible costs, to complete revitalization plans and implementation strategies for areas or communities affected by the presence of multiple brownfield sites and site assessments for strategic sites.
ELIGIBLE ACTIVITIES - Communities may apply to enter the program at the most appropriate of the three program steps described below leading to New York State's designation of the Brownfield Opportunity Area:
Step 1: Pre-Nomination Study - The Pre-Nomination Study provides a preliminary description and analysis of the proposed Brownfield Opportunity Area. The Pre-Nomination Study will be reviewed by the New York State Departments of State and Environmental Conservation to determine if a community should proceed with a Nomination to designate a Brownfield Opportunity Area.
Step 2: Nomination - The Nomination step provides an in-depth and thorough description and analysis, including an economic and market trends analysis, of existing conditions, opportunities, and reuse potential for properties located in the proposed Brownfield Opportunity Area with an emphasis on the identification and reuse potential of strategic brownfield sites that are catalysts for revitalization.
Step 3: Implementation Strategy - The Implementation Strategy provides a description of the techniques and actions to implement the revitalization plan. Site assessments on strategic brownfield sites may be eligible for funding if environmental data is required.
ELIGIBLE APPLICANTS - Applicants that are eligible to apply for a grant include:
New York State Municipalities - New York State municipalities are defined as: cities; villages; towns; counties; local public authorities; local public benefit corporations; school districts; improvement districts; and Indian nations or tribes.
Community Based Organizations - Community based organizations are defined as: not-for-profit corporations that are incorporated under Section 501 (c) (3) of the Internal Revenue Code whose stated mission is to promote community revitalization within the geographic area in which the community based organization is located; has 25 percent or more of its Board of Directors residing in the community in such area; and represents a community with a demonstrated financial need as indicated by high unemployment, low resident incomes, depressed property values, and/or high commercial vacancy rates.
Community Boards - Community Boards are defined as New York City Community Boards as set forth in Section 2800 of the New York City Charter.
Municipalities, Community Based Organizations and/or New York City Community Boards Acting in Cooperation - Two or more eligible applicants may, and are encouraged to, submit a joint application.

The BOA recipient and its contractors must make Good Faith Efforts to subcontract a portion of the Contract amount to Minority and Women Owned Business Enterprises (M/WBE). The percentage goals for MBE and WBE participation are 8.8% for Commodities, services/technologies, and 6% for Construction in the Upstate NYSDEC Regions 3-9. For New York City and Long Island NYSDEC Regions 1 & 2, MBE utilization goal percentages are 18.8% for Commodities, services/technologies and 21.5% for Construction. WBE goal percentages are 20.5% for Commodities, services/technologies, and 13.7% for Construction for New York City and Long Island. The recipient and its contractors must make Good Faith Efforts to employ 10% minority group members and 10% women for a portion of the workforce hours required to perform the work under this Contract. Appendix B of the State Assistance Contract further defines the M/WBE and EEO provisions required by Executive Law, Article 15.

Environmental Restoration Projects Program; Title 5 of the 1996 Clean Water/Clean Air Bond Act (ERP)
This notice is to advertise the availability of State Assistance funding to municipalities for Environmental Restoration Projects to investigate and/or remediate hazardous substances on property held in title by a municipality. A municipality may obtain "temporary incidents of ownership" during a tax foreclosure proceeding for a property in order to conduct such investigation. Applications are accepted on a continuous basis. The Environmental Restoration Program provides reimbursement of up to 90% of on-site eligible costs and up to 100% for off-site eligible costs and 50% for demolition costs. Funding was allocated for this Program under the 1996 Clean Water/Clean Air Bond Act. Funding is available until the allocation is committed.
Eligible applicants are New York State Municipalities. Municipalities are defined as a local public authority or public benefit corporation, county, city, town, village, school district, supervisory district, district corporation, improvement district within a county, city town or village, or Indian nation or tribe recognized by the State and the U.S. within a reservation wholly or partly within NY State boundaries, or any combination thereof. For purposes of the ERP, the term municipality includes a municipality acting in partnership with a community based organization. Community based organizations are defined as not-for-profit corporations, exempt from taxation under section 501(c)(3) of the internal revenue code whose stated mission is promoting reuse of brownfield sites within a specified geographic area in which the community based organization is located, which has twenty-five percent or more of its board of directors residing in the community in such area; and represents a community with a demonstrated financial need. Project eligibility requirements are detailed in enabling legislation and regulations (see 6NYCRR Subpart 375-4).

Hudson-Fulton-Champlain Quadricentennial (HFCQ) Grant Program
Applications will be accepted through September 3, 2008 for HFCQ grant projects located entirely within NYS, within the Champlain Valley, the Hudson Valley, the New York Harbor vicinity (including the five boroughs) or more specifically within the confines of the following counties: Westchester, Rockland, Putnam, Orange, Dutchess, Ulster, Greene, Columbia, Albany, Rensselaer, Saratoga, Washington, Warren, Essex and Clinton. Funding in the amount of $1,000,000 is currently available from the Environmental Protection Fund for HFCQ grants. The HFCQ grant program specifically seeks to achieve or support the following or similar types of projects: museum and/or cultural institution exhibits; music and performing arts performances; sporting and/or outdoor events; films and documentaries; educational and/or curriculum projects; or publications and book projects. Eligible applicants may request funding at the minimum amount of $1,000 up to the maximum amount of $50,000. Matching funds are not required.

MUNICIPALITIES WITH A LANDFILL UNDER ORDER TO CLOSE
Applications will be accepted continuously. The program is for municipalities with inactive solid waste landfills or landfills that will be inactive within 18 months of application that have eligible closure costs incurred after April 1, 1993. They will be eligible to recover up to 50 percent of the eligible costs (90 percent for municipalities with populations less than 3,500) up to maximum of two million dollars. The program is authorized by ECL Article 56, Title 4 and Article 54, Title 5, with specific requirements detailed in 6NYCRR Subpart 360-9.

MUNICIPALITIES WITH GAS COLLECTION SYSTEM AT CLOSED LANDFILL
Applications will be accepted continuously. The program is for municipal owners or operators of landfills who have incurred costs associated with the design and construction of active landfill gas collection and treatment systems. They will be eligible to recover up to 50 percent of the associated costs, up to a maximum of two million dollars. Eligible costs include: design and construction of gas collection and conveyance systems and purchase and installation of stationary flares, internal combustion engines or turbines used to treat (burn) the landfill gas. The program is authorized by ECL Article 56, Title 4 and Article 54, Title 5.

Technical Asistance Grants
Applications are continuously being accepted for DEC Environmental Remedial Technical Assistance Grants (TAG). TAGs are awarded to qualified applicants on a first-come, first-served basis, in the order in which complete applications are received. There is no matching contribution required on the part of the grant recipient.
Under the TAG program, eligible community groups may apply to receive grants for up to $50,000 per site to obtain independent technical assistance about State Superfund Program and Brownfield Cleanup Program sites that pose a significant threat to public health or the environment. Eligible community groups must be non-responsible parties incorporated as not-for-profit corporations under section 501(c)(3) of the Internal Revenue Code. A qualifying group must certify that its membership represents the interest of the community affected by the site, and that its members' health, economic well-being or enjoyment of the environment are potentially threatened by the site.
Portions of technical assistance work may be subcontracted based on unit price bids/quotes for professional services to subconsultants, subject to the guidance from and approval of the Department.

Title 3 State Assistance Program authorized under the 1986 Environmental Quality Bond Act and Article 52 of the Environmental Conservation Law
This notice is to advertise the availability of State Assistance funding to municipalities under Consent Order for remediation of hazardous waste sites. The Title 3 State Assistance Program provides reimbursement of up to 75% of eligible costs.
Assistance under the Title 3 Program is available to a municipality (city, county, town, village, or Indian tribe residing within New York State, or any combination thereof) under Consent Order for the development and implementation of remediation of hazardous waste sites which remains in compliance with such order and submits a complete grant applicant for funding.

Funding for Emergency Repair of Housing Occupied by Low Income Seniors
DESCRIPTION: Request For Proposals (RFP)/Application packages for funding for the Residential Emergency Services To Offer Repairs to the Elderly (RESTORE) Program. Applications will be available at NYS Division of Housing and Community Renewal (DHCR) regional offices and from the DHCR web site. Applications may be submitted electronically and are expected to be available on the DHCR website, www.nysdhcr.gov, by August 15, 2008. In order to expedite the processing of applications, applicants are encouraged to submit their applications using the Community Development On-Line application system. Assistance in preparing applications is available from DHCR regional office staff.
APPLICATION DEADLINE: Applications for RESTORE funding must be received by the Housing Trust Fund Corporation by 5:00 PM, EST., Tuesday, September 23, 2008. Individuals who hand deliver site-specific applications must have picture identification and a transmittal letter, on organization letterhead, stating their name and authorizing that person to deliver the application. Applications delivered by commercial carrier must have a complete and legible return address. Failure to comply with these requirements may result in an application not being accepted.
The Housing Trust Fund Corporation (HTFC) expects to have approximately $3,000,000 in RESTORE Program funds remaining available from the 2008 budget appropriation. Applications for programs located in one of the 19 counties listed below will receive preference for selection. These are counties where HTFC did not receive requests for funding or make awards under the RESTORE Program in the last funding round. To the extent that eligible and feasible applications for projects located in these counties do not utilize all available funds, HTFC will consider applications for proposals on a statewide basis. This RFP provides only a portion of the information and materials needed by applicants. It is anticipated that another notice of funding availability will be issued late this year for 2009 funds.
Targeted Counties: Columbia, Dutchess, Erie, Franklin, Genesee, Lewis, Livingston, Montgomery, Niagara, Oneida, Orleans, Oswego, Saratoga, Schoharie, Seneca, Sullivan, Tioga, Ulster and Yates.
GENERAL: HTFC reserves the right to award all, a portion of, or none of the program funds based upon funding availability, the feasibility of the applications received, the competitiveness of the applications and the applicant's ability to meet HTFC criteria for funding.
Applications are selected for funding based upon an evaluation process which includes completeness, eligibility, competitiveness, and recommendations as detailed in the RFP/application packet. Selections are also made in compliance with all pertinent statutory requirements and furtherance of the State's housing goals. The RFP to be issued is part of the funding application. Applicants should refer to the RFP to determine eligibility requirements.
In accordance with Section 312 of Article 15 A of the Executive Law, HTFC requires contractors and awardees to make affirmative efforts to ensure that New York State certified minority and women owned business enterprises have opportunities for meaningful participation on projects awarded funding by HTFC.
Meetings for technical assistance may be scheduled through the staff of one of the regional offices listed below to provide applicants with an opportunity to discuss an application prior to the due date for submission. Staff will also be available by phone, email or in person (schedule permitting) to answer applicant questions.

NOTE: HTFC has developed a simplified application and review process for applicants requesting only Urban Initiatives Program funds, Rural Area Revitalization Projects funds, or Small Projects Program funds. Refer to the DHCR website (www.nysdhcr.gov) for further information.

Application materials will be distributed starting one half-hour before each workshop. Materials will also be available on the DHCR web site (www.nysdhcr.gov) beginning on August 15, 2008.

Programs Serving the Felony Jail or Prison-Bound Population, and/or Programs Which Increase the Effectiveness of Existing ATI Programs as an Effective Alternative to Jails or Prison, and/or Programs Designed to Assist Those Returning to the Communities From Prison
DPCA has announced the availability to fund service providers from across the state that provide Alternative-to-Incarceration (ATI) and re-entry services programs. This Request for Proposals (RFP) is seeking applications to fund the following program/services types up to $200,000 each:
• Programs serving the felony jail or prison-bound population, and/or
• programs which increase the effectiveness of existing ATI programs as an effective alternative to jails or prison, and/or
• programs designed to assist those returning to the communities from prison
Programs may provide services to a criminal justice population that helps connect them to mentoring, vital mental health and substance abuse treatment including treatment for co-occurring disorders, expanded job training and placement services, and transitional housing and case management services in order to promote a reduction in recidivism and increase success among the ATI population served and the recently released offender.
Service providers eligible to apply include public agencies or private not-for profit organizations within New York State that currently provide probation or alternatives-to-incarceration programs.
