Notice of Abandoned Property Received by the State Comptroller
Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. A list of the names and last known addresses of the entitled owners of this abandoned property is maintained by the office in accordance with Section 1401 of the Abandoned Property Law. In the Matter of Considering the Continuation of the New York State Apple Research and Development Program Pursuant to Article 25 of the Agriculture and Markets Law and 1 NYCRR Section 204.12
PRELIMINARY STATEMENT
Section 204.12 of Title One of the Official Compilation of Codes, Rules and Regulations of the State of New York (1 NYCRR), relating to the New York State Apple Research and Development Program (Program), provides that once during each six-year period the Program is in effect, the Commissioner shall conduct a referendum of eligible New York State apple growers to determine whether they approve the continuation of the Program. Continuation of the Program is subject to the approval of not less than 50 percent of such growers voting in the referendum. Upon such approval, a new six-year period begins as of the first of April of the year following the date on which approval of continuation of the Program is certified.
FINDINGS AND CONCLUSIONS
Pursuant to a Notice of Referendum dated March 12, 2008, a referendum of eligible New York State apple growers was conducted through April 21, 2008 to determine whether such growers approve continuation of the Program. The results of the referendum have been duly recorded and verified as follows:
In favor.......... 173 (86.9%)
In opposition.... 26 (13.1%)
Total eligible ballots counted and verified: 199
In addition, 8 ballots were declared ineligible, as follows:
5 ballots were not marked “yes” or “no”
3 ballots were received after the deadline date

Pursuant to Section 30-a of the Public Lands Law, the Office of General Services hereby gives notice to the following:
Notice is hereby given that the New York State Office of Children & Family Services has declared that 8.052 +/− acres of vacant land, located off of County Highway 107 in the Town of Johnstown, County of Fulton, is no longer useful for State program purposes and has been declared abandoned to the Commissioner of General Services for sale or other disposition as unappropriated State land. This abandonment was approved May 8, 2008.

Division of Housing and Community Renewal
To administer federal funds for the Community Development Block Grant (CDBG), Home Investment Partnerships (HOME), Emergency Shelter Grants (ESGP) and Housing Opportunities for Persons with AIDS (HOPWA) programs, New York State must prepare an Annual Action Plan (AAP). The State's next AAP will describe the anticipated use of federal CDBG, HOME, ESGP
and HOPWA funds in 2009 to address affordable housing and community development needs identified in its Consolidated Plan for 2006-2010, as well as describe the State's methods for distributing these funds to local grantees.
Individuals and organizations are encouraged to participate in the development of the 2009 Annual Action Plan by submitting written comments to: DHCR, Attention: Brian McCarthy, 38-40 State St., Albany, NY 12207, or [email protected]. Involved is the construction of a new building known as the Hampton Inn and Suites, located at 2361 South Road, Town of Poughkeepsie, County of Dutchess, State of New York.
2008-0300 Matter of George Pundt, P.O. Box 38, Skaneateles Falls, NY 13153, for a variance concerning building safety requirements, including relief from requirements to remove existing roof layers prior to re-roofing.
Involved is the re-roofing of a one-family dwelling, located at 26 Ellicott Avenue, City of Batavia, County of Genesee, State of New York.
