Pursuant to section 207 of the State Administrative Procedure Act (SAPA), notice is hereby provided that upon publication of the amended Five Year Review of Existing Regulations and the conclusion of the forty-five (45) day public comment period, no public comments were received regarding any of the subject rules. The rules referenced herein have functioned consistent with the purposes underlying their adoption and shall be continued without modification.

Rules adopted in 1998

Section 4.5 of Title 4 NYCRR was amended to provide for a probationary term of 26-52 weeks for the competitive class title of Highway Maintenance Worker 2, salary grade 10.

Section 5.10 was added to 4 NYCRR to provide for the establishment of redeployment lists for employees serving in positions designated managerial or confidential (m/c).

Provisions of Parts 21 and 28 of 4 NYCRR were amended to permit New York State departments and institutions to authorize eligible employees to use and/or be advanced sick leave credits to obtain and train a guide dog or service animal.

Rules adopted in 2003

Section 75.1 of 4 NYCRR was amended to permit employees who leave public service after vesting in a retirement plan or system administered by the State of New York or a civil division thereof, and who defer receipt of their pension benefits, to continue group life insurance coverage.

Section 82.3 of 4 NYCRR was amended to provide for the authorized release of personal medical records upon request of the data subject in conformance with the New York State Personal Privacy Protection Law (PPPL).
