Water Rates and Charges
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission is considering whether to approve or reject, in whole or in part, or modify, a request filed by Knolls Water Co., Inc. to increase rates and the surcharge for major renovations, and thereafter get automatic annual rate increases, of five percent or the Consumer Price Index of Greater New York whichever is greater.

Subject:
Water rates and charges.
Purpose:
To increase rates and the surcharge for major renovations and going forward approve automatic rate increases for Knolls Water Co., Inc.
Substance of proposed rule:
On May 8, 2008, Knolls Water Co., Inc. (Knolls or the company) electronically filed Leaf 12 Revision 4 and Escrow Account for Major Renovations Statement No. 3 to tariff schedule P.S.C. No. 3—Water to become effective August 1, 2008. The company proposes to increase its annual operating revenues by $17,874 or approximately 30.42% over the revenue allowed when in its last increase, became effective August 1, 2005. The Orange County Department of Health is requiring the company to install an additional well and replace its existing storage tank. The company requests to be allowed to modify its existing escrow account for major renovations to increase the quarterly surcharge from $25 to $100 per customer so that it can complete the required improvements in a reasonable amount of time. Knolls also requests approval of automatic annual rate increases, beginning January 1, 2010, of 5% or the Consumer Price Index of Greater New York, which ever is greater. Knolls' tariff is available on the Commission's Home Page on the World Wide Web (www.dps.state.ny.us located under Commission Documents). The company provides flat rate water service to approximately 79 customers in an area known as Forest Knolls on Greenwood Lake in the Town of Warwick, Orange County. The Commission may approve or reject, in whole or in part, or modify the company's request.
