Water Rates and Charges
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission is considering whether to approve or reject, in whole or in part, a filed request by Arbor Hills Waterworks, Inc. to modify the terms of its emergency escrow account to recover revenue losses due to reduced water sales caused by a ban on the use of water for lawn sprinkling.
Statutory authority:
Public Service Law, sections 4(1), 5(1)(f) and 89-c(1) and (10)
Subject:
Water rates and charges.
Purpose:
To allow recovery of revenue losses due to reduced sales.
Substance of proposed rule:
On April 22, 2008, Arbor Hills Waterworks, Inc. (Arbor Hills or the company) filed a petition for approval to modify the terms of its emergency escrow account to enable it to recover revenue losses caused by reduced sales. The company has been having problems meeting the demands caused by the customers' automatic lawn sprinkler systems. In order to be able to provide its customers adequate service for domestic purposes, the company imposed a ban on the use of water for lawn watering. To date the company's attempts to obtain additional supply have failed and it is expected that the lawn watering ban will have to continue. The company states the ban caused a significant loss in Arbor Hills' 2007 revenue (about $5,800 net of changes in production costs) which the company cannot absorb and it is expected that the loss revenue from the lawn watering ban will be even greater in 2008. The use of the emergency escrow account for recovering lost revenue caused by the lawn watering ban would continue until the company's next filing at which time such lost revenue would be rolled into base rates. The company provides metered water service to 67 customers in the Arbor Hills development in Westchester County. The Commission may approve or reject, in whole or in part, or modify the company's request.
