Pursuant to the authority vested in me, and in consultation with the Administrative Board of the Courts, and with the approval of the Court of Appeals of the State of New York, I hereby amend, effective immediately, section 36.4(d) of the Rules of the Chief Judge, relating to exception from the procedures governing appointments of fiduciaries, to read as follows:

§ 36.4 Procedure After Appointment

(d) Exception. The procedure set forth in this section shall not apply to the appointment of a referee to sell real property and a referee to compute whose compensation for such appointments is not anticipated to exceed [$550] $750.

the suspension of section 510.18 of the Rules of the Court of Appeals in Capital Cases (22 NYCRR 510.18)

Pursuant to its general rule making authority and L 1995, ch 1, the Court of Appeals promulgated 22 NYCRR 510.18 to ensure the collection of data reports in capital cases and their compilation into a uniform Capital Case Data Report in compliance with Judiciary Law § 211-a. This Court hereby suspends, until further order, the operation of 22 NYCRR 510.18, effective January 30, 2008, or as soon thereafter as section 52 of the Judiciary Law is compiled with.
