PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission is considering whether to approve or reject, in whole or in part, or modify, a petition filed by Birch Hill Water Supply Corporation for the authority to enter into financing in order to make water system improvements and to institute a customer surcharge to support the financing.
Statutory authority:
Public Service Law, sections 4(1), 5(1)(f), 89-c(1), (10) and 89-f
Subject:
Financing and water rates and charges.
Purpose:
To approve financing in order to make water system improvements and to institute a customer surcharge to support the financing.
Substance of proposed rule:
On November 13, 2007, Birch Hill Water Supply Corporation (the company) filed a petition requesting Public Service Commission approval to enter into a financing of approximately $525,000 in order to make water system improvements and to institute a customer surcharge to support the financing. The company provides metered rate water service to 68 residential customers located in the Town of Beekman, Dutchess County. The Commission may approve or reject, in whole or in part, or modify, the company's petition.
