PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
The commission, on Nov. 7, 2007, adopted an order directing Consolidated Edison Company of New York Inc. (Con Edison) to defer on its books from shareholder funds a ratepayer credit of $18 million for not meeting the reliability goals for 2006 under the terms of the reliability performance mechanism (RPM).

Public Service Law, sections 65 and 66
Subject:
Con Edison's 2006 reliability report.
Purpose:
To require a ratepayer credit of $18 million.
Substance of final rule:
The Public Service Commission adopted an order directing Consolidated Edison Company of New York Inc. to defer on its books from shareholder funds a ratepayer credit of $18 million for not meeting the reliability goals for 2006 under the terms of its Reliability Performance Mechanism.
