PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
The commission, on Sept. 19, 2007, adopted an order in Case 07-E-0723 approving the petition filed by 123 Washington LLC to submeter electricity at 123 Washington St., New York, NY.

Public Service Law, sections 2, 4(1), 65(1), 66(1), (2), (3), (4), (12) and (14)
Subject:
Petition for the submetering of electricity.
Purpose:
To grant the petition of 123 Washington LLC to submeter electricity at 123 Washington St., New York, NY.
Substance of final rule:
The Commission approved a petition by 123 Washington LLC to submeter electricity at 123 Washington Street, New York, located in the territory of Consolidated Edison Company of New York, Inc.
