Establishing an Electric Surcharge to Fund Energy Efficiency Programs
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The Public Service Commission has instituted a proceeding, in Case 07-M-0548, to explore and develop the means by which the State's electric energy consumption can be decreased by 15% from expected levels by the year 2015, and will include development of an electric and natural gas energy efficiency portfolio standard. In this proceeding, the commission is considering establishing an electric surcharge to fund energy efficiency programs.

Public Service Law, sections 2, 5 and 66
Subject:
The commission is considering adopting recommendations for energy efficiency programs that can be implemented quickly and cost-effectively, in order to expedite attainment of energy savings, while the planning process to develop an energy efficiency portfolio standard is underway.
Purpose:
To consider whether the commission should establish an electric surcharge to fund energy efficiency programs.
Substance of proposed rule:
The Public Service Commission has instituted a proceeding, in Case 07-M-0548, to explore and develop the means by which the State's electric energy consumption can be decreased by 15% from expected levels by the year 2015, and will include development of an electric and natural gas Energy Efficiency Portfolio Standard. In this proceeding, the Commission is considering establish an electric surcharge to fund energy efficiency programs. This surcharge would be applied to customer bills, and may be collected on a volumetric basis from all firm customers.
The Commission may approve, reject, or modify, in whole or in part, its proposal to establish an electric surcharge to fund energy efficiency programs, and it may also consider other related matters.
