PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 12/15/11, the PSC adopted an order denying the request of Oot Bros., Inc. for a refund of $67,870.22 from Niagara Mohawk Power Corporation d/b/a National Grid, and granting a limited waiver for those letters of credit prior to 3/1/10.

Purpose:
To deny a refund of $67,870.22 and grant a limited waiver for letters of credit prior to 3/1/10.
Substance of final rule:
The Commission, on December 15, 2011 adopted an order denying the request of Oot Bros., Inc. for a refund of $67,870.22 from Niagara Mohawk Power Corporation d/b/a National Grid, and granting Oot Bros., Inc. a limited waiver for those letters of credit posted prior to March 1, 2010, for the tariff permitting Oot Bros., Inc. to extend each of these letters of credit for up to five years from the date of this order, subject to the terms and conditions set forth in the order.
