PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
On 12/15/11, the PSC adopted an order approving the petition of Sithe/Independence Power Partners, L.P. under Public Service Law 9 and 2, to guarantee credit facilities up to a maximum amount of $1.25 billion.

Public Service Law, sections 69 and 82

Purpose:
To approve the petition to guarantee credit facilities up to a maximum amount of $1.25 billion.
Substance of final rule:
The Commission, on December 15, 2011 adopted an order approving the petition of Sithe/Independence Power Partners, L.P. under Public Service Law § 69 and § 82, to guarantee credit facilities up to a maximum amount of $1.25 billion, subject to the terms and conditions set forth in the order.
