PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The commission is considering whether to approve or reject, in whole or in part, or to modify a petition filed by Niagara Mohawk Power Cororation and New Visions Powerline Communications, Inc. on Dec. 28, 2006 regarding Niagara Mohawk Power Corporation leasing space on their distribution lines for Broadband Over Powerline to New Visions Powerline Communications, Inc.
Statutory authority:
Public Service Law, sections 66(1), 70 and 107
Subject:
Broadband over powerlines.
Purpose:
To consider Niagara Mohawk Power Corporation's request for leasing distribution lines to New Visions Powerline Communications, Inc. for Broadband Over Powerline services.
Substance of proposed rule:
The Commission is considering whether to approve or reject, in whole or in part, or to modify a petition filed by Niagara Mohawk Power Corporation and New Visions Powerline Communications, Inc. on December 28, 2006 regarding Niagara Mohawk Power Corporation leasing space on their distribution lines for Broadband Over Powerline to New Visions Powerline Communications, Inc.
