PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed action:
The commission is considering the petition of Beaver Dam Lake Water Corporation for approval to issue and sell long-term debt in an amount not to exceed $2.1 million and to increase a water surcharge.
Statutory authority:
Public Service Law, sections 89-f and 89-c(10)
Subject:
Issues of stock, bonds and other forms of indebtedness; charges.
Purpose:
To allow Beaver Dam Lake Water Corporation to enter into a loan agreement and increase charges.
Substance of proposed rule:
The Commission is considering whether to approve, reject or modify the petition of Beaver Dam Lake Water Corporation for approval to enter into a loan agreement with the Environmental Facilities Corporation for a total amount of $2.1 million. The loan will be for either thirty or twenty years, depending on whether the company is successful in obtaining a hardship designation from the Environmental Facilities Corporation. Additionally, in order to pay for the loan the company has asked to increase its current customer surcharge from $320 per customer to approximately $900.
