Acceleration of the Return of Tax Savings to Ratepayers
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition filed on August 27, 2018 by New York American Water Company, Inc. that proposes the accelerated return of customer credit arising out of the federal income tax rate change for the period 1/1/18 to 9/30/18.
Statutory authority:
Public Service Law, sections 65(1), 66(1), (4), 79(1), (7), 89-b(1), 89-c(1), (3), 91(1), 94(2) and 95(2)
Subject:
Acceleration of the return of tax savings to ratepayers.
Purpose:
To determine the timetable for returning tax savings to ratepayers.
Substance of proposed rule:
The Commission is considering a petition filed on August 27, 2018 by New York American Water Company, Inc. (NYAW) that proposes to accelerate the return of a customer credit arising out of the federal income tax rate change from January 1, 2018 through September 30, 2018, resulting from the Tax Cuts and Jobs Act of 2017. On August 9, 2018, the Commission issued an Order determining that NYAW should institute a sur-credit for ratepayers including annual ongoing savings from the tax changes and a three-year amortization of savings accumulated from the implementation of the tax changes to the start of the sur-credit (January 1, 2018 through September 30, 2018). The estimated amount of the deferred credit is approximately $2.3 million. In its current petition, NYAW proposes the accumulated savings be returned to ratepayers as a one-time sur-credit.
