The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for long term care services to comply with enacted statutory provisions. The following changes are proposed:
Long Term Care Services
The quality incentive program for non-specialty nursing homes will continue for the 2018 rate year and continue to recognize improvement in performance and provide for other minor modifications.
There is no additional estimated annual change to gross Medicaid expenditures attributable to this initiative for State Fiscal year 2018/2019.
The public is invited to review and comment on this proposed State Plan Amendment, a copy of which will be available for public review on the Department’s website at http://www.health.ny.gov/regulations/state_plans/status. Effective on or after December 1, 2017 any changes to the State’s Medicaid Plan (Plan) that require a State Plan Amendment (SPA) that have an impact on Indians, Indian nation leaders and health clinic administrators and Urban Indian Organization leaders and health department administrators will now receive tribal consultation via electronic mail (e-mail). This will include a copy of the Federal Public Notice, draft plan pages, along with a cover letter offering the availability of State staff to meet with respective Indian leaders in person upon requests made within two weeks of the date of notification.

Office of Mental Health and Department of Health
Pursuant to 42 CFR Section 447.205, the Office of Mental Health and the Department of Health hereby give public notice of the following:
The Office of Mental Health and the Department of Health propose to amend the Title XIX (Medicaid) State Plan for institutional services related to temporary rate adjustments to Article 28 Hospitals that are undergoing a closure, merger, consolidation, acquisition or restructuring of themselves or other health care providers. These payments are currently authorized by 2807-c (35) of the New York Public Health Law. The following changes are proposed:
Additional temporary rate adjustments have been reviewed and approved for the following hospitals:
• Arnot Health, Inc./ St. Joseph’s Hospital
The aggregate payment amounts total up to $301,744 for the period December 1, 2017 through March 31, 2018.
The aggregate payment amounts total up to $618,290 for the period April 1, 2018 through March 31, 2019.
The aggregate payment amounts total up to $590,069 for the period April 1, 2019 through March 31, 2020.
The aggregate payment amounts total up to $289,897 for the period April 1, 2020 through March 31, 2021.

Department of State Notice of Review for the City of Buffalo Draft Local Waterfront Revitalization Program
In accordance with the New York State Waterfront Revitalization of Coastal Areas and Inland Waterways Act and the New York State Coastal Management Program, the City of Buffalo, located within Erie County, has prepared a Draft Local Waterfront Revitalization Program (LWRP). The LWRP is a comprehensive management program for the City’s waterfront resources along Lake Erie, the Niagara River, the Buffalo River, Scajaquada Creek and Cazenovia Creek.
To approve the City of Buffalo LWRP, pursuant to Article 42 of the NYS Executive Law, it is required that potentially affected State, federal and local agencies be consulted to assure that the program does not conflict with any existing policies and programs.
The Draft LWRP was accepted by the New York State Department of State as complete and is now available for review by potentially affected State, federal and local agencies, and the public. Comments on the Draft LWRP are due by February 20, 2018. For this purpose, the City of Buffalo Draft LWRP is available online at: http://www.dos.ny.gov/opd/programs/WFRevitalization/LWRP_draft.html.
At the close of the required review period, the Department of State will coordinate responses to all comments received with the City of Buffalo, and modifications to the Draft LWRP will be made as needed. Following adoption of the LWRP by the City and its subsequent approval by the Secretary of State, pursuant to 15 CFR 923.84(b), the New York State Department of State will request incorporation of the City of Buffalo LWRP into the State’s Coastal Management Program by NOAA’s Office for Coastal Management as a Routine Program Change.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant below has certified that proposed activities comply with and will be conducted in a manner consistent with the approved New York State Coastal Management Program (NYSCMP). The applicant’s consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue, in Albany, New York.
In F-2017-0754, “Kennedy Pier Reconstruction”, the applicant –The Breezy Point Cooperative (Breezy Point Co-op. or BPC) – proposes to reconstruct, in-place, the Kennedy Pier located on the western end of the north shore of Rockaway Point, NY – approximately - North of 406 Bayside, Rockaway Point, County of Queens, NY, at the Rockaway Inlet.
According to the information submitted to the Department of State:
This pier “provides fishing and viewing to the Breezy Point Community” and “the pier sustained damage during Superstorm Sandy in 2012. Action is now required to make repairs and to institute various measures designed to minimize the potential for similar damage to occur in the future.”
The applicant proposes to:
• Remove in its entirety the existing fixed pier configuration consisting of 1) an approximately 18’ x 26’ concrete platform located at the landward end of a fixed pier; 2) a pile supported fixed pier (8’ x 338’) with (10) ten batter piles waterward of mean high water; 3) a 24’ x 42’ pier head with a 146 square feet angled access platform; and (2) two four-pile dolphins.
• Install 1) an 8’ x 372’ fixed pier, including a 110 square foot trapezoidal shaped access section at the waterward end, with (24) twenty four twelve-inch (12”) diameter batter piles (wrapped in 0.30” thick PVC) installed waterward of mean high water; 2) a 24’-8” x 42’ pier head; 3) an approximately 8’ x 24’ pile supported concrete ramp located at the landward end of the fixed pier above; and 4) install (2) two seven pile dolphins.
The proposed pile supported concrete ramp and pier configuration will encompass an area of approximately 4,226 square feet, approximately 2,234 square feet of which is waterward of mean high water; The new proposed pier head will have a higher top elevation varying between 6.0’ NAVD88 and 8.0’ NAVD88 (as compared to the present elevation constant at 6.0’ NAVD88) to protect the structure from damage from storm surge and wind driven waves.
The purpose of the proposed pier reconstruction and modifications is to restore the previous level of safety and recreational functionality of the existing pier, and to reduce susceptibility of the pier to damage from ice flows and elevated water levels associated with storms. The purpose of the proposed concrete ramp is to continue to allow and improve the ability of emergency response vehicles to directly access the pier in the event of an emergency.
This project involves utilizing proposed federal financial assistance through the United States Department of Housing and Urban Development (HUD).
The above-referenced project is located within the New York City Waterfront Revitalization Program (WRP) planning area and proposed activities are subject to evaluation under the policies and purposes of the federally approved program.

The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. In F-2017-0819, Frank M. Flower and Sons, Inc. has submitted a pre-construction notification for re-authorization under the 2017 Nationwide Permit #48, and is requesting a formal waiver from the U.S. Army Corps of Engineers of the 2017 Nationwide Permit #48 regional condition restricting shellfish harvesting during the period between March 16th and October 31st of any given year. The applicant is currently operating under the 2012 Nationwide Permit and has a thirty (30) year lease of the underwater lands from the Town of Oyster Bay within Oyster Bay and Cold Spring Harbor, Nassau County; the current lease will expire in 2024.
On March 17, 2017, the NYS DOS issued a consistency determination for the 2017 Nationwide Permit (NWP) Program, which can be viewed at: http://www.nan.usace.army.mil/Portals/37/docs/regulatory/publicnotices/Regional%20Gen%20Permit/F-2016-1155OBJ_CDLfinal.pdf?ver=2017-03-22-111200-710. In that determination, DOS objected to NWP #48: Commercial Shellfish Aquaculture Activities, thus requiring a full federal consistency review and consistency determination from the NYS DOS for all activities proposed under NWP #48.

In F-2017-0922 (FA), “Seagate Community Bulkheads Project”, the Federal Emergency Management Agency (FEMA) – proposes to provide federal financial assistance through its Public Assistance (PA) Program (FEMA-4085-DR-NY-Superstorm Sandy: Hazard Mitigation Program (HMGP-0035) #2510 -to assist the Seagate Community, Brooklyn, NY (sub-grantee) with the building of eight sections of bulkhead along its western and southern shores.
According to information submitted by the federal agency to the Department of State, “the sub-grantee proposes to replace bulkhead that was destroyed by Hurricane Sandy within the project limits. The installation of the proposed bulkhead will result in a continuous line of protection measures throughout the project limits that provide protection to a minimum of Elevation 11.0 NAVD88 (2% annual or 50-year flood event).”
The above-referenced project is located within the New York City Waterfront Revitalization Program (WRP) planning area and proposed activities are subject to evaluation under the policies and purposes of the federally approved program.

Susquehanna River Basin Commission Commission Meeting
SUMMARY: The Susquehanna River Basin Commission will hold its regular business meeting on December 8, 2017, in Annapolis, Maryland. Details concerning the matters to be addressed at the business meeting are contained in the Supplementary Information section of this notice.
DATES: The meeting will be held on Friday, December 8, 2017, at 9 a.m.
