Department of Health
Pursuant to 42 CFR Section 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for all services to comply with enacted statutory provisions. The following changes are proposed:
All Services
Under Section 6411 of the Affordable Care Act (P.L. 111-148), Expansion of the Recovery Audit Contractor (RAC) Program, which amends section 1902(a)(42) of the Social Security Act, states were required to establish programs to contract with RACs to audit payments to Medicaid providers by December 31, 2010 and fully implement such by April 1, 2011.
New York State is seeking to request an exception to the three-year look back period for the Medicaid RAC program as defined by State regulation, and give the State the ability to grant a look back period for the Medicaid RAC up to six years. The longer look back period will allow the State to review claim specific detail for any overpayments; is more consistent with Medicaid provider record retention requirements required by State regulatory agencies; and allow for additional efficiencies for both the State and provider when a single effort can review and recover an identified overpayment rather than leveraging multiple entities to review and recover different time periods.
This exception shall be effective January 1, 2013, and only apply to reviews based on actual claim specific detail. Audits that require sampling and extrapolation will continue to be limited to the three- year look back period.
There is no additional estimated annual change to gross Medicaid expenditures as a result of the clarifying proposed amendments.

Correction of prior public notice concerning extension of public comment period
On November 28, 2012, a public notice appeared in the State Register which extended the public comment period for revised proposed regulations published on October 31, 2012 concerning Limits on Administrative Expenses and Executive Compensation. The notice extended the public comment period from November 30, 2012 to December 14, 2012 for proposed rules published by a number of state agencies. The public notice listed the Office for People With Developmental Disabilities (OPWDD) in error. The close of the public comment period for OPWDD was originally set at December 24, 2012 and is unchanged.

Department of State F-2012-0668 and F-2012-0686 Date of Issuance – December 12, 2012
The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
In two related projects detailed below, F-2012-0668 and F-2012-0686, the Town of Southampton (applicant and lead agency) has certified that the proposed activities comply with and will be conducted in a manner consistent to the maximum extent practicable with the New York State Coastal Management Program. The applicant's federal consistency certification and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2012-0668 (or "Sagaponack" project), the Town proposes to contract for the dredging of approximately 1,035,000 cubic yards of beach compatible sand from an offshore borrow area and placement of the dredged material as nourishment "to restore eroded dunes and beach" along 14,125 linear feet of shoreline fronting both private residential properties and the Town owned beaches and underwater lands. In F-2012-0686 (or the "Bridgehampton-Watermill" project), the Town proposes to contract for the dredging of approximately 950,000 cubic yards of beach compatible sand from an offshore borrow area and placement of the dredged material as nourishment "to restore eroded dunes and beach" along 15,626 linear feet of shoreline fronting both private residential properties and the Town owned beaches and underwater lands. The offshore borrow areas constitute a public resource and are underwater lands held in the public trust for the people of the State of New York. Disposal and use of this resource is at the discretion of the New York State Office of General Services.
According to the information provided to the Department of State: the borrow areas are located on average within two miles of the receiving shorelines (within New York State economic waters); the borrow areas are situated beyond the depth of closure or the distance from shore within which such sand resources may be significant to onshore transport of sand from offshore ridges and thus might be an important contributor over time to the existing sand supplies as part of the natural littoral system; benthic surveys and habitat studies indicate no significant impact would result from proposed dredging of sand from the elevated underwater features; on-shore nourishment activities would be conducted according to currently accepted best management practices and during New York State Department of Environmental Conservation approved windows of time for such activities in order to minimize impacts to birds, fish, and other species; both projects will be funded through taxation of the benefitting property owners via the formation of special erosion control tax districts (ECDs) and in conjunction with contributions from the Town of Southold; the specific details of funding remain to be finalized pending legislative determinations; the Town of Southold has agreed to act as lead agency and shall issue a decision determining the level of environmental review necessary in completing the State Environmental Quality Review Act (SEQRA) process. No alternative actions have been proposed at this time.
