PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
Amendment of Part 415 of Title 18 NYCRR.
Statutory authority:
Social Services Law, sections 20(3)(d), 34(3)(f) and 390-c
Subject:
Direct deposit for child care providers receiving child care assistance.
Purpose:
To implement requirements of section 390-c of the Social Services Law, as amended by L. 2021, ch. 650.

Initial Review of Rule
As a rule that requires a RFA, RAFA or JIS, this rule will be initially reviewed in the calendar year 2025, which is no later than the 3rd year after the year in which this rule is being adopted.
Assessment of Public Comment
A comment of support was received from one source: Civil Service Employees Association (CSEA).
CSEA supports the amendment of regulation 18 NYCRR 415.5 to require districts to offer a direct deposit option for providers receiving child care assistance. CSEA noted that implementing direct deposit will aid in preventing financial hardships that may arise due to the mishandling of paper checks as well as offer a more timely, reliable, and stable manner of payment for child care providers.
No comments in opposition were received. The proposed changes to 18 NYCRR 415.5 will be adopted as published.
