PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition filed by Astoria Generating Company, L.P. for a lightened regulatory regime in connection with its ownership and operation of a battery storage project in Astoria, Queens, New York.
Statutory authority:
Public Service Law, sections 2(12), (13), 5(1)(b), 64-69, 69-a, 70-72, 72-a, 105-114, 114-a, 115, 117, 118, 119-b and 119-c
Subject:
Establishment of a lightened regulatory regime applicable to a battery storage project.
Purpose:
To ensure appropriate regulation of an electric corporation.
Substance of proposed rule:
The New York State Public Service Commission (Commission) is considering a petition filed by Astoria Generating Company, L.P. (AGC) on December 15, 2021 requesting a lightened regulatory regime in connection with a battery storage project that AGC is developing in Astoria, Queens, New York.
AGC requests an order providing that it will be regulated as an electric corporation under a lightened regulatory regime consistent with that imposed on independent power producers in the wholesale electric market. AGC also seeks a Certificate of Public Convenience and Necessity pursuant to section 68 of the Public Service Law.
