Transfer of Street Lighting Facilities
PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following proposed rule:
Proposed Action:
The Commission is considering a petition filed by Niagara Mohawk Power Corporation d/b/a National Grid to transfer certain street lighting facilities in the City of Saratoga Springs to the City of Saratoga Springs.
Statutory authority:
Public Service Law, sections 5, 65, 66 and 70(1)
Subject:
Transfer of street lighting facilities.
Purpose:
To determine whether to authorize the transfer street of lighting facilities and the proper accounting for the transaction.
Substance of proposed rule:
The Public Service Commission (Commission) is considering a petition filed on January 31, 2022 by Niagara Mohawk Power Corporation d/b/a National Grid (National Grid), requesting authorization to transfer certain street lighting facilities located in the City of Saratoga Springs (City) to the City.
The original cost of the facilities was approximately $1,093,597 and the net book value of the assets is $513,699, as of November 30, 2021. National Grid proposes to transfer the street lighting facilities to the City for approximately $506,567, which reflects the net book value of the assets, transition and transaction costs, and a one-time price reduction of $58,513 that will be fully absorbed by shareholders. National Grid explains that the agreement between it and the City provides that the purchase price will be adjusted (up or down) to reflect the actual net book value at the date of the closing.
