Washington Pattern Jury Instructions Recent Updates

Update published in January 2024 (reflecting changes to the WPIC that are current as of September 2023):
Instructions or commentary were added or revised in the following chapters: Chapter 2 (Definitions).

Update published in December 2021 (reflecting changes to the WPIC that are current as of September 2021):
Instructions or commentary were added or revised in the following chapters: Chapter 50 (Uniform Controlled Substances Act); Chapter 52 (Special Defenses—Uniform Controlled Substances Act); and Chapter 55 (Legend Drugs).

Update published May 2021 (reflecting changes to the WPIC that are current as of September 2020):
The May 2021 update reflected the publication of the Fifth Edition of the WPIC. This fifth edition of Volumes 11 and 11A includes new and revised instructions as well as the withdrawal of some no longer needed. New for this edition are Chapter 21 (Reimbursement of Defense Costs) regarding reimbursement when a defendant successfully defends by raising a claim of self defense, as well as when a law enforcement officer successfully uses the defense of justified force, and Chapter 135 (Animal Cruelty). Significant revisions have been made in the following: Chapter 35 (Crimes Against Persons) to reflect the new crime of felony assault in the fourth degree; Chapter 36 (Harassment, Hate Crimes, and Domestic Violence) to reflect the new crime of hate crime effective July 28, 2019, as well as a statutory change to the definition of domestic violence; Chapter 131 (Identity Theft) to reflect statutory changes that elevate the level of offense when the victim of identity theft is a senior or vulnerable adult; and Chapter 133 (Weapon Offenses) to reflect statutory changes effective July 28, 2019, that expand the definition of unlawful possession of a firearm. The Committee deleted Chapter 31 (Capital Cases) because the death penalty is no longer applicable in Washington State. Individual instructions in other chapters were also revised.

Update published July 2019 (reflecting changes to the WPI that are current as of September 2018):
The July 2019 update reflected the publication of the Seventh Edition of the WPI. The Seventh Edition includes new and revised instructions that were first published in either the 2013 Supplement or the 2017–2018 Supplement to the sixth edition of the civil pattern jury instructions. New and revised instructions for WPI Chapters 107 (Legal Malpractice), 165 (Negligent Misrepresentation), 310 (Consumer Protection Actions), 320 (Insurance Bad Faith Actions), 340 (Civil Rights—General introductory Instructions), 341 (Civil Rights—Municipal and Local Government Liability), 342 (Civil Rights—Fourth Amendment—Unreasonable Search and Seizure), and 348 (Civil Rights—Damages and Verdict Forms) were included in the 2013 Supplement. New and revised instructions for WPI Chapters 110 (Product Liability), 150 (Eminent Domain—General Instructions), 151 (Eminent Domain—Special Instructions), 155 (Workers’ Compensation), 330 (Employment Discrimination), 360 (Involuntary Treatment—Mental Illness), 365 (Involuntary Treatment—Sexually Violent Predators), and 380 (Nuisance) were included in the 2017-2018 Supplement.

Instructions or commentary were added or revised in the following chapters: Chapter 0 (Introduction to WPIC), Chapter 1 (Introductory Instructions), Chapter 37 (Robbery), 151 (Basic Concluding Instruction), and 155 (Concluding Instruction—Lesser Degree/Lesser Included/Attempt).

Update published October 2016 (reflecting changes to the WPIC that are current as of August 2016):
The October 2016 update reflected the publication of the Fourth Edition of the WPIC. The following chapters in Volumes 11 and 11A of the civil instructions were significantly revised in this update: Chapter 29 (Miscellaneous Crimes Against Life); Chapter 31 (Capital Cases—Death Penalty Instructions); Chapter 37 (Robbery); Chapter 39 (Kidnapping, Unlawful Imprisonment and Custodial Interference); Chapter 49 (Indecent Liberties); Chapter 49A (Sexual Depictions Of Minors); Chapter 49C (Failure to Register as a Sex or Kidnapping Offender for Crimes on or After July 22, 2011); Chapter 50 (Uniform Controlled Substances Act); Chapter 52 (Special Defenses—Uniform Controlled Substances Act); Chapter 61 (Vehicle Prowling); Chapter 70 (Theft); Chapter 71 (Retail Theft); Chapter 77 (Possessing Stolen Property); Chapter 85 (Malicious Mischief); Chapter 88 (Arson—Definitions); Chapter 99 (Ignition Interlock); Chapter 120 (Obstructing Governmental Operation); Chapter 131 (Identity Theft); Chapter 133 (Weapon Offenses); Chapter 190 (Special Verdict Forms); and Chapter 300 (Exceptional Sentences—Aggravating Circumstances). Update published December 2014 (reflecting changes to the WPIC that are current as of September 2014):
The following material was changed or added in the Criminal Pattern Jury Instructions: Chapter 39A (Human Trafficking), Chapter 49C (Failure to Register as a Sex or Kidnapping Offender for Crimes on or after July 22, 2011), and Chapter 99 (Ignition Interlock) are new chapters added in this update. Other new instructions include: WPIC 6.52 (Eyewitness Identification Testimony), WPIC 36.81–36.86 (Cyberstalking), and WPIC 77.30–77.36 (Trafficking in Stolen Property). Chapter 35 (Assault and Reckless Endangerment) and Chapter 36 (Harassment and Domestic Violence) have been substantially revised. Initiative 502 (approved November 6, 2012), concerning the use of marijuana, has been incorporated into Chapter 92 (Driving Under the Influence).

Finally, WPIC 5.40, 48.04.01, 96.11, 96.12, and Appendices B (Trial Procedures Concerning Criminal Instructions) and C (The Criminal Jury Trial) are withdrawn.

Update published in May 2013 (reflecting changes to the WPI that are current as of April 2013):
The following chapters in Volumes 6 and 6A of the civil instructions were revised in their entirety: Chapter 310 (Consumer Protection Actions); Chapter 320 (Insurance Bad Faith Actions); Chapter 340 (Civil Rights—General Introductory Instructions); Chapter 341 (Civil Rights—Municipal and Local Government Liability); Chapter 342 (Civil Rights—Fourth Amendment—Unreasonable Search And Seizure); and Chapter 348 (Civil Rights—Damages and Verdict Forms). Appendix H (Consumer Protection Act Per Se Violations) was also revised in its entirety. Additionally, the following new chapters were added: Chapter 107 (Legal Malpractice); Chapter 165 (Negligent Misrepresentation); and Chapter 343 (Civil Rights—Conditions of Confinement).

Update published in May 2012 (reflecting changes to the WPI that are current as of January 2012):
The May 2012 update reflected the publication of the Sixth Edition of the WPI. The following chapters in Volumes 6 and 6A of the civil instructions were revised in their entirety in this update: Chapter 45 (Verdict Forms); Chapter 110 (Product Liability); Chapter 130 (Landlord and Tenant); Chapter 351 (Trade Secrets); and Chapter 352 (Tortious Interference with Economic Relations). Additionally, two Comments had minor changes: WPI 12.02 (Duty of One Confronted by an Emergency); and WPI 365.00(Sexually Violent Predators).
