WPIC CHAPTER 49C. Failure to Register as a Sex or Kidnapping Offender for Crimes on or After July 22, 2011
WPIC 49C.07 Kidnapping Offender Registration Requirement—Definition
A person is required to register as a kidnapping offender in the State of Washington if
[the person was convicted of a kidnapping offense, and on or after July 27, 1997, was in the custody of (select alternative from RCW 9A.44.148(d)) as a result of that offense] [or]
[the person was convicted of a kidnapping offense and was under the custody or under jurisdiction of (select alternative from RCW 9A.44.148(1)(d) or (g)) as a result of that offense on or after July 27, 1997, regardless of when the kidnapping offense was committed] [or]
[the person was convicted of a kidnapping offense that was committed on or after July 27, 1997] (RCW 9A.44.148(1)(b)) [or]
[the person has been found not guilty by reason of insanity of committing a kidnapping offense, regardless of when the offense was committed] (RCW 9A.44.148(1)(j)) [or]
[The person was convicted of a kidnapping offense under the laws of [this state] [another state] [a foreign country] [a tribe] [a federal or military tribunal] and moved to Washington state from [another state] [a tribe] [a foreign country], regardless of when the kidnapping offense was committed or the conviction occurred].
NOTE ON USE
This instruction lists five common statutory requirements for registration of a kidnapping offender. Use only one of the bracketed options.
This instruction includes the sources of only the most commonly used statutory registration requirements. Other possibilities exist for out-of-state, federal, military, tribal, and foreign convictions under RCW 9A.44.148(1)(i).
The statutory citation at the end of each registration requirement is included exclusively for ease of reference and should not be included in the instruction given to the jury.
COMMENT
RCW 9A.44.148. The statute imposes a lifetime registration requirement on kidnapping offenders who move to Washington State from another state, tribe, or a foreign country. RCW 9A.44.148(1)(i).
