Use this instruction when the defendant is charged with Class C felony failure to register as a sex offender and the charging document alleges that the defendant has previously been convicted of felony failure to register as a sex offender. Use this instruction with WPIC 49C.02 (Failure to Register as Sex or Kidnapping Offender—Elements).
Use bracketed material as applicable.
If there is a stipulation between the parties regarding an element of the offense, particular care must be taken to modify this instruction, if necessary, to reflect the terms of the stipulation.
