WPIC CHAPTER 49C. Failure to Register as a Sex or Kidnapping Offender for Crimes on or After July 22, 2011
WPIC 49C.01 Failure to Register as Sex or Kidnapping Offender—Definition
A person commits the crime of failure to register [as a [sex] [kidnapping] offender] when that person, having been [convicted] [found not guilty by reason of insanity] of [an offense] [a [felony] [sex] [kidnapping] offense] for which the person is required to register [as a [sex] [kidnapping] offender], knowingly fails to comply with requirements of [[sex] [kidnapping] offender] registration.

Use this instruction if it will help the jury understand the charged offense or if it is necessary to define this particular offense for the jury. See the Comment to WPIC 4.24 (Definition of the Crime—Form.)
Use bracketed material as applicable. If there is a stipulation between the parties regarding an element of the offense, particular care must be taken to modify this instruction, as necessary, to reflect the terms of the stipulation.

COMMENT
RCW 9A.44.130; RCW 9A.44.132.
RCW 9A.44.132 provides, in part, that a person commits the crime of failure to register if a person has a duty to register and fails to comply with “any of the requirements” of RCW 9A.44.130. The WPI Committee has not included the phrase “any of the requirements” in the instruction, because it may be confusing to jurors who are instructed as to only the specific registration requirements the State alleges have been violated.
