WPIC 48.27 Patron—Commercial Sexual Abuse of a Minor—Definition
A “patron” is a person who
[[provides] [or] [agrees to provide] [a fee] [anything of value] to another person as compensation for a sexually explicit act of a minor] [or]
[[solicits] [or] [requests] a sexually explicit act of a minor in return for a fee].

Use this instruction for crimes committed on or after June 7, 2012. Use with WPIC 48.26 (Sexually Explicit Act—Definition) and WPIC 47.09 (Minor—Definition).

RCW 9.68A.101(3)(e).
The statute was amended in 2012 to add the alternative means of sexually explicit acts to the definition of promoting commercial sexual abuse of a minor. The amendment also defined the word “patron” for purposes of the new alternative means. See RCW 9.68A.101(3)(e). The statute was revised, effective July 23, 2017, to provide for “anything of value” rather than a “fee” as set forth in the first alternative. The instruction has been revised for this edition to reflect the change. “Anything of value” should be used for offenses committed after July 23, 2017. For offenses before that date, given that the statute of limitations is 10 years or the victim's 30th birthday, whichever is later, “fee” remains a bracketed option. See RCW 9A.04.080(1) (statute of limitations). The statutory revision did not change “fee” in the second alternative.
