COMMENT
Pursuant to RCW 46.61.525, negligent driving in the second degree is a traffic infraction, rather than a crime. There is no right to a jury trial. It is error to include second degree negligent driving as a lesser included offense of negligent driving first degree. State v. Farr-Lenzini, 93 Wn.App. 453, 970 P.2d 313 (1999).
