COMMENT
The WPI Committee has withdrawn this instruction because in 2009, the Legislature eliminated the misdemeanor crime of malicious mischief in the third degree. All third degree malicious mischief offenses committed on or after September 1, 2009, are gross misdemeanors. RCW 9A.48.090. See Laws of 2009, Chapter 431, § 6 (effective July 26, 2009).
