WPIC 50.67 Civic Center—Definition
“Civic center” means a publicly owned or operated place or facility used for recreational, educational, or cultural activities.
NOTE ON USE
Use this instruction as applicable, with WPIC 50.61 (Enhanced Sentence—Controlled Substance Violations Under RCW 69.50.435—No Statutory Defense—Special Verdict) or WPIC 50.61.01 (Enhanced Sentence—Controlled Substance Violations Under RCW 69.50.435—Statutory Defense—Special Verdict).
COMMENT
RCW 69.50.435.
The enhancement only applies to civic centers designated as drug-free zones by the local governing body. The drug free zone includes the area within one thousand feet of the perimeter only if the governing body has specifically designated that perimeter. See RCW 69.50.435(1)(j).
