WPIC CHAPTER 50. Uniform Controlled Substances Act
WPIC 50.17 Sell/Price/for Profit—Definition
To sell means to pass title and possession for a price [whether or not the price is paid immediately or at a future date]. Price means anything of value. For profit means the obtaining of anything of value in exchange for the controlled substance.
NOTE ON USE
Use this instruction with WPIC 50.15 (Sale of Controlled Substance—Definition) and WPIC 50.16 (Sale of Controlled Substance—Elements).
COMMENT
RCW 69.50.410(1)(a), (b), (c).
A sale of a controlled substance for money or anything of value constitutes a sale for profit; there is no requirement that the State prove a profitable sale as opposed to a sale in which the seller lost money or did not make a profit in the usual sense. This statutory definition of profit is not unconstitutionally vague. State v. Leek, 26 Wn.App. 651, 614 P.2d 209 (1980).
