WPIC 49A.12 Live Performance—Definition
Live performance means any play, show, skit, dance, or other exhibition performed or presented to or before an audience of one or more.
NOTE ON USE
Use this instruction with WPIC 49A.02 (Sexual Exploitation of a Minor—Elements).
COMMENT
RCW 9.68A.011(6). The definition applies regardless of whether consideration is given for the performance. The WPI Committee did not include this phrase because jurors will not necessarily understand the legal meaning of the word “consideration” and because the phrase is not strictly necessary to the definition. The phrase may be added to the instruction in appropriate cases, although it would be preferable to use “admission fee” or some other term relevant to the particular case rather than the legal term “consideration.”
