“Basic necessities of life” means food, water, shelter, clothing, and medically necessary health care [, including but not limited to health-related treatment or activities, hygiene, oxygen, and medication].
NOTE ON USE
Use this instruction to define “basic necessities of life” in cases involving criminal mistreatment or abandonment. Use the bracketed phrase when health care is an issue. For directions on using bracketed phrases, see WPIC 4.20 (Introduction).
COMMENT
RCW 9A.42.010(1).
The term “shelter” in this definition does not encompass the concept of protection of one's child from an assault by a third person. State v. Jackson, 137 Wn.2d 712, 976 P.2d 1229 (1999).
For a discussion of the various exceptions and defenses for criminal mistreatment and abandonment offenses, see WPIC 38.00 (Introduction).
