COMMENT
This instruction is withdrawn. In previous editions, WPIC 36.55 consisted of a special verdict form to be used with the concluding instruction at WPIC 36.54. The WPI Committee now recommends that the enhancing factors generally be included as elements and not be presented to the jury as special verdicts. See the Note on Use and Comment to WPIC 36.51 (Violation of a Court Order (RCW 26.50.110)—Gross Misdemeanor—Elements).
