In 1997 the Legislature amended RCW 9A.36.011 and RCW 9A.36.021 to make exposure or transmission of H.I.V. a first degree, rather than second degree, assault. See WPIC 35.06 (Assault—First Degree—Poison—H.I.V.—Elements).
