WPIC 20.07 Insanity—Recovery at Time of Trial
The WPI Committee recommends that no instruction on recovery at time of trial be given.
COMMENT
No special instruction is needed. Recovery at the time of trial is covered by the special verdict form, WPIC 190.03 (Special Verdict Form—Insanity), and therefore is automatically submitted to the jury whenever insanity is submitted as a defense.
