WPIC CHAPTER 5. General Principles of Evidence
WPIC 5.10 Soliciting False Evidence or Suppression of Evidence—Defendant
(The WPI Committee recommends that no instruction be given on this subject.)
COMMENT
A defendant's attempt to persuade a witness not to testify, or to tamper with other evidence, may be admissible as bearing on consciousness of guilt. See generally, Tegland, 5 Washington Practice, Evidence Law and Practice § 402.4 (6th ed.). An instruction on this subject, however, should not be given because it tends to single out or emphasize certain evidence.
