WPIC 2.26 Sexual Motivation—Definition
Sexual motivation means that one of the purposes for which the defendant committed the crime was for the purpose of [his or her] sexual gratification.
NOTE ON USE
Use this instruction with WPIC 160.00 (Concluding Instruction—Special Verdict—Penalty Enhancements) and WPIC 190.08 (Sexual Motivation—Special Verdict).

This definition has been upheld as being neither unconstitutionally vague nor void for overbreadth. State v. Halstien, 122 Wn.2d 109, 857 P.2d 270 (1993) (interpreting parallel provision in the Juvenile Justice Act).
