Do not use this instruction for traffic offenses in Title 46 of the Revised Code of Washington. For traffic offense cases, the applicable instruction is WPIC 98.01 (Traffic Cases—Vehicle—Definition).

COMMENT
RCW 9A.04.110. The statute states that the word “vehicle” means “a ‘motor vehicle’ as defined in the vehicle and traffic laws, any aircraft, or any vessel equipped for propulsion by mechanical means or by sail.” A riding lawnmower is not a “motor vehicle” within the meaning of RCW 9A.56.065-theft of a motor vehicle. See discussion in State v. Barnes, 189 Wn.2d 492, 403 P.3d 72 (2017).” A snowmobile is a ‘motor vehicle’ for purposes of RCW 9A.56.065.” State v. Wolvelaere, 195 Wn.2d 597, 611, 461 P.3d 1173 (2020).
If it is necessary to further define the word “motor vehicle,” see RCW 46.04.320 (defining the word for purposes of Washington's motor vehicle laws). See also RCW 46.04.670 (defining “vehicle” for purposes of Washington's motor vehicle laws).
