WPIC 1.03 The Information
(The WPI Committee recommends that the language of the charging information against the defendant not be included in the written instructions to the jury.)
COMMENT
Language from the charging information should not be included in the written instructions at the end of the trial, even though such language is appropriately read to jurors before voir dire. See WPIC 1.01 (Advance Oral Instruction—Beginning of Proceedings) (language from the charging information is read to provide jurors with a context for what follows). In the written instructions, the required elements are instead set forth in the to-convict instruction, which follows the format of WPIC 4.21 (Elements of the Crime—Form), et seq. A reading of the information brought against the defendant would be repetitious and not helpful to the jury.
