WPIC 36.27.02 Stalking—Correctional Agency—Definition
“Correctional agency” means
[the Department of Natural Resources in a correctional setting]
[the Department of Corrections]
[the Indeterminate Sentence Review Board]
[the Department of Social and Health Services] [or]
[any state, county, or municipally operated agency with the authority to direct the release of a person serving a sentence or term of confinement].
NOTE ON USE
The instruction defines a term used in WPIC 36.21.01 (Stalking—Felony—Definition) and WPIC 36.21.06 (Stalking—Felony—Victim with Official Capacity in Legal System—Elements).
In many cases, the simpler approach will be to incorporate the pertinent parts of this instruction into the to-convict instruction, WPIC 36.21.06 (Stalking—Felony—Victim with Official Capacity in Legal System—Elements), instead of using this separate instruction. For example, the to-convict instruction could be phrased in terms of stalking an “employee of the Department of Corrections.”
