WPIC CHAPTER 135. Animal Cruelty
WPIC 135.25 Animal Cruelty—Animal—Definition
[[For purposes of first degree animal cruelty,] “animal” means every creature, either alive or dead, other than a human being.]
[[For purposes of [second degree animal cruelty] [animal fighting] [mutilating an animal], “animal” means any [nonhuman mammal] [bird] [reptile] [or] [amphibian].]
NOTE ON USE
Use the first paragraph when a defendant is charged with first degree animal cruelty. Use the second paragraph whenever a defendant is charged with second degree animal cruelty, animal fighting, or mutilating an animal. Use bracketed material as appropriate.
COMMENT
The first paragraph is based on RCW 16.52.205(8)(a). The second paragraph is based on RCW 16.52.011(2)(b).
