WPIC 300.38 Aggravating Circumstance—Paying to View Internet Depictions of Minor Engaged in Sexually Explicit Conduct [RCW 9.94A.535(3)(bb)]

COMMENT
RCW 9.94A.535(3)(bb).
This aggravating circumstance was added to the Sentencing Reform Act in 2010. Laws of 2010, Chapter 227, § 10 (effective June 10, 2010). This circumstance only applies to the crime of viewing depictions of a minor engaged in sexually explicit conduct. RCW 9.68A.075.
The statutory presumption is that this aggravating circumstance will be presented to the jury during the trial of the alleged crime. RCW 9.94A.537(4).
